A buyer comparing two Intracoastal-view condos on Flagler Drive this summer will see one number that matters on the portal and a second, quieter number that shows up only in the association budget. The first is the water-view premium. The second is what that view costs to keep, insure, and eventually finance out of.
For most of the last decade, the first number told the story. In 2026 it no longer does. The spread between new-construction and resale on the same corridor is widening for reasons that have almost nothing to do with the view and almost everything to do with a December 31 deadline.
The West Palm Beach median sale price sat at $425,000 in June 2026, with the market taking an average of 80 days to move a home. That figure describes the city, not the corridor. Those numbers are real, and they are also the ones every competing guide already publishes. They do not explain why two similarly priced Flagler condos can carry very different lifetime costs.

As of January 1, 2026, associations can no longer vote to waive or reduce reserve funding for eight structural components: roof, load-bearing walls and primary structural members, fire protection, plumbing, electrical, waterproofing, windows and exterior doors, and any other item over $25,000 affecting those systems. The Structural Integrity Reserve Study, or SIRS, that translates those obligations into a funding schedule must be completed by December 31, 2026 for associations that existed on or before July 1, 2022.
In Palm Beach County, milestone inspections start at 25 years for buildings within three miles of the coastline, not 30. Every waterfront condo on Flagler Drive falls inside that three-mile band by geography. The result is that a 1990s-vintage building with beautiful sightlines is now, in 2026, either finishing its first milestone inspection, funding the reserves the study requires, or negotiating a special assessment to close the gap.
A buyer underwriting a Flagler purchase should treat four items as part of the price, not as post-closing surprises:

For new-construction towers, the entire regulatory apparatus is a non-issue for at least the first decade. For resale inventory in the same corridor, the questions a well-prepared buyer asks now look different than they did in 2023. Has the milestone Phase 1 been filed. Was Phase 2 triggered. Is the SIRS current, and does its funding plan match the current budget. Are any special assessments pending in board minutes from the last twelve months. Is the building on the Fannie Mae unavailable list, and what is the master insurance status.
The portals show a view. The board minutes show what the view costs to keep. In 2026, the spread between the two is where the real price discovery is happening on Flagler Drive.
The new-construction cluster along Flagler has been shaped by a specific set of demand drivers. Wells Fargo's wealth management headquarters relocation is bringing thousands of high-income professionals within walking distance, and Vanderbilt University's $520 million graduate campus commitment is a longer-dated signal that the urban core is not a cyclical story. Forbes reported in April 2026 that a $772 million construction loan package for the CityPlace office towers underscored institutional confidence in the "Wall Street South" narrative, which in turn supports the higher-density residential pipeline along Flagler and around CityPlace. Forest Development and Royal Palm Companies have added Oculina to the pipeline, planned for 399 units on an adjacent Intracoastal site.
That pipeline is why the new-construction premium is not simply about newness. The units at Palm Beach House on Flagler Drive, for example, offer Intracoastal views, hurricane impact glass, private beach access, and a rental profile that appeals to investor buyers, but the number that matters is the one on the last board resolution, not the one on the listing sheet.
Does the SIRS deadline affect single-family waterfront homes? No. The milestone inspection and SIRS framework under Florida Statute 553.899 and Chapter 718 apply to condominium and cooperative buildings of three or more habitable stories. Single-family and small multi-family homes are outside the statute.
Can a seller withhold that a special assessment is being discussed? Florida disclosure practice and the board's own minutes create a paper trail. A prepared buyer will request the last twelve months of board meeting minutes and the current reserve study before removing contingencies. This is a practical due diligence step, not a legal opinion, and a Florida real estate attorney should confirm the disclosures required for any specific transaction.
Is pre-construction always the better underwrite on Flagler? Not always. Pre-construction reservations typically secure the 8–12% pricing advantage but come with 24-month or longer delivery windows and developer risk. Move-in-ready inventory in a well-managed new building carries a premium and no wait. Resale in a compliant, well-reserved older building can be the best per-square-foot entry if the diligence checks out.
